You (carrier or haulier) are legally responsible for submitting the ENS data. A third party, such as the importer or an intermediary, can lodge the declaration on the transporter’s behalf. However, the transporter is still responsible for making sure the declaration is submitted.

Any hauliers not providing the correct declaration will not be able to travel and/or face penalties.

Frequently Asked Questions

about the Entry Summary Declaration (ENS)

ENS is a mandatory electronic declaration for all goods entering the EU or the UK. It provides customs authorities with detailed cargo information, enabling a prior assessment of safety and security risks. This requirement is in line with the World Customs Organization’s SAFE Framework of Standards.

Responsibility for submitting the ENS generally lies with the carrier, the operator of the active means of transport who brings the goods into the customs territory concerned. In some cases, a freight forwarder or customs representative may submit the ENS on behalf of the carrier, with his agreement.

It must contain at least the following information:

  • Shipper and consignee details (name, address, EORI number if available).
  • Detailed description of goods, including the recommended 6-digit HS (Harmonized System) code.
  • Mode of transport and associated details (container number, seal number, gross weight, etc.).
  • Transport information (mode, identification, nationality, date/time of arrival, itinerary details).
  • Unique consignment reference and transport document reference.
  • Safety/security information, especially for dangerous goods.

Submission deadlines vary according to the mode of transport:

  • Sea transport (containers): at least 24 hours before loading at the port of departure.
  • Road transport: at least 1 hour before arrival at the border.
  • Inland waterways and rail: no later than the time of departure.
  • Air transport: at the latest when the aircraft takes off.

To submit an ENS, the following steps are generally followed:

  1. Obtain an EORI (Economic Operator Registration and Identification) number: necessary for all companies involved in customs activities within the EU or the UK.
  2. Register with the appropriate department: for example, Safety and Security (S&S GB) for imports into the UK.
  3. Use our compliant software: compatible customs software is required

Non-compliance with ENS obligations may result in :

  • Delays in the unloading or delivery of goods.
  • Financial penalties imposed by customs authorities.
  • Disruption to supply chain operations.
It is therefore crucial to ensure that the
  • ENS is submitted with complete and accurate information within the required deadlines.

There are some exceptions, including:

  • Movement of qualified goods from Northern Ireland to Great Britain.
  • Goods transiting Ireland before entering Great Britain.

However, most other movements of goods into the EU or the UK require an ENS.

To transport goods from Morocco to the European Union, a carrier must provide several documents to ensure compliance with European customs regulations. Among them, the T1 document is crucial when goods are in transit under customs control. Here is a precise explanation of the requirements and documents needed:

1. What is the T1 document?

The T1 is a customs document used for common transit. It allows non-EU goods to be transported through several EU countries without paying customs duties or taxes until they reach their final destination.

This document is essential if the goods are to transit through several countries, or if they have not yet been cleared through customs.

2. Documents required for a Moroccan carrier

A carrier must provide :

  • EORI number (Economic Operator Registration and Identification):Mandatory for all companies dealing with European customs.
  • Entry Summary Declaration (ENS): Submitted prior to arrival in the EU for risk assessment.
  • T1 document (if applicable): This document is issued by the customs office of departure or an authorized freight forwarder to cover the transit of goods.
  • Bill of lading or CMR (Convention on the Contract for the International Carriage of Goods by Road): Depending on the mode of transport used.
  • Commercial invoice and packing list: Specifying the nature, quantity, weight and value of the goods.
  • Certificate of origin: If goods benefit from preferential agreements (e.g. Morocco-EU Agreement).
  • Transport insurance: To cover goods in the event of a claim.

3. T1 document procedures

  • Issuing the T1: The carrier or an authorized forwarder must request the T1 from the Moroccan or European customs office when the goods leave.
  • Guarantee: The T1 requires a financial guarantee covering any customs duties and taxes, provided by an approved organization.
  • T1 tracking: A Movement Reference Number (MRN) is assigned to track the status of the goods throughout transit.
  • T1 closure: The document is closed when the goods arrive at the customs office of destination, where they will be cleared through customs.

4. Importance of the T1

The T1 facilitates the movement of goods in transit within the EU without the need for repeated formalities at each border. It is particularly useful for Moroccan goods transiting several European countries before reaching their final destination.

By following these steps and providing the necessary documents, Moroccan carriers ensure the smooth transit of their goods, and avoid penalties or delays. For assistance with customs documentation, including T1 creation, we offer solutions tailored to your needs.
