FRANCE : NEW PENALTY FOR TAKING RESTS IN CABIN OF LCV (UP TO 1500 EUR)

According to the new regulations, entered into force since September 4, 2020 in France, companies will be fined with a new high penalty (up to 1500 euros) for taking daily and weekly rests in the cabin of a vehicle up to 3.5 tons. So all daily and weekly rests needs to be organized somewhere out of the cabin.

By specifying this means that, in the case of transport light vehicles up to 3.5 tons, according to the new regulations, driver may only take short breaks in the cabin during his daily working hours. The daily (after min.  11 hours) or weekly rests should be taken outside the vehicle.

The Article  R. 3315-11 5°  and L 3313-4 Transport Code is modified including the modalities and penalty for missing these obligations.
