New minimum wage in France

With effect from 01.01.2019, the minimum wage for 2019 in France is set at 10.03 € gross per hour.

This implies that your truck drivers will have to be paid at least 10.03 € for any working hour spent in France from 1st January 2019 and that all new or renewal declarations made from 1 st January 2019 will have to mention at least the new minimum wage at 10.03 € per hour.

What should be considered when calculating the minimum wage for the driver?

We would like to draw your attention to what to consider when calculating the minimum wage for the driver for work hours in France. Based on the information published by the French authorities:

Pursuant to paragraph 7 of article 3 of Directive 96/71/EC of 16 December 1996, the following elements may be considered:

– the employee’s wage

– any additional pay for overtime

– any perquisites (e.g. length of service bonus)

– any allowances specific to the posting (e.g. expatriation bonus)

– any benefits in kind.

These amounts are expressed gross.

However, any allowances paid in reimbursement of expenditure actually incurred on account of the posting, such as expenditure on travel, board and lodging – and including any such amounts paid on a fixed-rate basis – may not be included.

What you should remember, all new or renewal declarations made from 1st January 2019 will have to mention the new minimum wage at 10.03 € per hour.

About your drivers’ declarations: all declarations issued up to 31/12/2018 can mention the 2018 minimum wage with no need to correct them, but make sure that 2019 payrolls will comply with the new French minimum wage, that is 10.03 € per hour.
