Violeta Bulc, European Commissioner for Transport, responded to a letter from a group of MEPs requesting to speed up the proceedings against Germany, France, and Austria regarding the national rules governing the minimum wage.
Commissioner Bulc informs that all cases concerning the violation of European freedoms are currently suspended.
According to the European Commission, only European legislative solutions, such as the Mobility Package, can ensure uniform legal standards, not infringement proceedings before the Court of Justice of the EU.
The Commissioner confirms that the proceedings have been suspended for the duration of works on the Mobility Package. Due to the lack of progress in both the Parliament and the Council, she assured that she would reflect on appropriate actions.
The proceedings have been going on for over three years. The European Commission has not responded to the question whether and to what extent EU law has been breached, leaving European carriers in legal uncertainty.
In short, we must remember the current suspension of proceedings against France, Germany and Austria, and the national procedures for the posting of drivers „Loi MACRON, MILOG and LSDB“ are still applicable until the publication of the new European regulation „mobility package“.
