Impact of the New Mobility Package

Transport companies have been looking forward to a final decision on the new regulatory package that may fundamentally change the rules of the transport market. The Mobility package was initiated by the European Commission in its 2017 Work Program “Europe on the Move”. It was created to improve drivers’ working conditions & safety and to ensure market’s fairness & efficiency. During these last days, from 8th to 10th of July 2020 , The European Parliament, European Council and European Commission have definitively adopted the final version of the Mobility Package regulations, that will be applied from 2nd of February 2022.

So, what will be the consequences for the transport sector?

The goal of the Mobility Package is to modernize, replace and merge provisions governing posting rules in the road transport sector by ensuring adequate working conditions for drivers and harmonizing administrative requirements and access to the road transport market.

What are the key points of the Mobility Package ?

The minimum wage laws become mandatory for all European Union countries. So, for example, if one of EU transport companies posts his driver to work in another EU country, they will need to pay the same wage as for the local driver.
2 New posting rules will be applicable to the international road transport operations, with the exemption of bilateral operations of transport of goods and passengers, and transit.
3 Return of the driver to the country of origin will be mandatory every 4 weeks for each period of 3 or 4 consecutive working weeks.
4 Regular weekly rest period (more than 45 hours) shall be taken in a suitable accommodation place paid by the company.
5 Drivers shall have a cooling off period of 4 days after the return to the home state of the vehicle.
6 Tachographs becoming mandatory for all vans/ light commercial vehicles between 2,5 tons to 3,5 tons, it will also imply that small transport operators will be subject to EU norms for transport
7 Obligation to return trucks to the company’s headquarters every eight weeks
8 In order to fight letter-box companies, transport companies shall prove their main activity in the establishment Country by:
– having an effective and stable establishment in a Member State
– having appropriate financial standing
– having the required professional competence

When the regulations for the Mobility Package will apply?

The Mobility package regulations will start to apply from 2nd of February 2022.

Important! The rules on rest times, including the return of drivers to their home Country, will apply from 20th/ 21st of August 2020.
