The IMI Posting Declaration requirement is based on Directive (EU) 2020/1057, part of the EU Mobility Package, which establishes specific driver posting rules for road transport.

This directive modifies general posting rules under Directive 96/71/EC and applies specifically to international road freight transport. It requires transport operators established in one EU Member State to declare drivers posted to another Member State via the IMI system (Internal Market Information system) before operations begin.

Scope includes:

  • Cabotage operations
  • Non-bilateral cross-border transport
  • Certain combined transport operations

Transit operations are excluded.

An IMI posting declaration for drivers is mandatory in the following cases:

  • Cabotage operations in a host Member State
  • Cross-trade transport (between two Member States where the operator is not established)
  • Certain combined transport activities

It is NOT required for:

  • Bilateral transport operations (with limited additional loading/unloading allowances under Mobility Package rules)
  • Pure transit without loading or unloading
